The court in Leipzig abolished the ban on the German government at an influential magazine at a distant right direct.
The decision sees them as a blow in the fighting in Germany against right-wing extremism, although it could be evidence of high standards of free speech in the country.
In July 2024. The German Ministry of Interior banned the magazine, claiming that it undermined the German Constitution with the rhetoric who attacked minorities.
“It is the central mouthpiece of right-wing extremist scenes,” Nancy Faeser said German interior minister at that time. “This magazine encourages unspeakable hatred against Jews, against people with migration backgrounds and against our parliamentary democracy.”
The magazine is connected to a distant right alternative to the German Party (AFD), and earlier German domestic intelligence was in the right wing.
On Tuesday, the ruling judges accepted that the magazine published anti-constitutional content, but decided that it did not justify the ban.
Many statements in compact can be seen as “excessively, but allowed criticism,” said the President of the Ingo Krafta. “The constitution guarantees freedom of expression and freedom of the press, even according to the enemies of the Constitution.”
After the announcement, COMPACT editor-in-chief of Jurgen Elsasser, who described his magazine as a “attack of democracy”, said the verdict would also help AFD foreigners. If his magazine can’t be banned, then I OFD, he said.
There is a ferrastic debate in Germany whether to try to ban AFD, that is also classified as right-handed extremists by German intelligence. Even many AFD critics say the ban could be counterproductive by playing in the narrative of the victim’s narrative.
During the past year, German officials banned or tried to ban, numerous anti-constitutional organizations, some associated with the distant right extremist groups. AFD and distant correct activists say that they suffocate them oppressive condition.
Some Donald Trump supporters also accused Germany to suppress the free speech. At the Security Conference in Munich in February USA Vice President JD Vance has been astonished European officials with a striking attack on Germanyaccusing the main politicians of the AFD closure from politics and anti-democratic terminals to freedom of speech.
In fact, AFD politicians are a combination of German TV stories and have equal deformational rights to the main parties in the German parliament.
Due to the German experience at the 20th century of pressure Nazi and communist totalitarian regimes, there are major obstacles to limiting speech and ban on publications and organizations.
Cases often lead to court and, as well as in this judgment, overturn the judges. The decision to publish the Danja Right Magazine compact to publish, the government cannot be complained.
